Terms of Use
These Terms of Use ("Terms") govern your use of the Amia AI app (the "App"), provided by Karen Walker, an individual developer ("we", "us"). By using the App you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the App.
1. Who can use the App
You must be at least 13 years old (16 in the EU and UK) to use the App. If you are under 18, you may use it only with the consent of a parent or legal guardian.
2. You are talking to AI
Answers, images and other content in the App are generated by artificial intelligence. You are talking to an AI, not a real person. Content may be inaccurate, incomplete or unexpected — check important information yourself. It is not medical, legal, financial, psychological or any other professional advice. If you are in crisis, contact local emergency services.
3. Acceptable use
You agree not to use the App to:
- create sexually explicit content or any sexual content involving minors;
- create content depicting real, identifiable people in a false or harmful way, or impersonate anyone;
- create content that promotes violence, self-harm, terrorism or hate, or is otherwise illegal;
- harass, threaten or exploit others, or share content from the App to do so;
- break, reverse-engineer, scrape or overload the App or bypass its limits and payments.
We may filter, refuse or remove content and suspend or delete accounts that break these rules.
4. Your content
You keep the rights you have in the messages you send. You give us a worldwide, non-exclusive, royalty-free licence to process them to run the App, generate responses, and prevent abuse. Content generated for you may be used by you for personal, non-commercial purposes. Similar content may be generated for other users.
5. Gems
Gems are a virtual item used inside the App to send messages beyond the free daily limit and to generate images and other extras. Gems have no cash value, cannot be transferred or exchanged for money, and are not refundable except where required by law. Prices and costs in gems are shown in the App and may change.
6. Premium subscription
- Premium is an auto-renewing subscription. The price and period are shown in the App before you buy.
- Payment is charged to your Apple ID account at confirmation of purchase.
- The subscription renews automatically unless cancelled at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the end of the period.
- You can manage and cancel subscriptions in your Apple ID account settings. Deleting the App or your account does not cancel a subscription.
- Refunds are handled by Apple under Apple's policies.
7. Availability and changes
We may change, suspend or discontinue any part of the App, including assistants, features, limits and prices, at any time. We may update these Terms; continuing to use the App after an update means you accept the new Terms.
8. Ending use
You can stop using the App and delete your account at any time in Profile → Delete account. We may suspend or end your access if you break these Terms. Unused gems are lost when your account is deleted or terminated.
9. Disclaimers
The App is provided "as is" and "as available", without warranties of any kind, to the extent permitted by law. We do not guarantee that the App will be uninterrupted, error-free or that generated content will be accurate or suitable for you.
10. Limitation of liability
To the extent permitted by law, we are not liable for any indirect, incidental, special or consequential damages, or for loss of data, profits or goodwill. Our total liability for any claim is limited to the amount you paid us in the 12 months before the claim.
11. Apple
These Terms are between you and us, not Apple. Apple is not responsible for the App or its content, has no obligation to provide maintenance or support, and is not responsible for any claims relating to the App. If the App fails to meet any applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any; Apple has no other warranty obligation. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. You confirm that you are not located in a country subject to a U.S. Government embargo and are not on any U.S. Government list of prohibited or restricted parties.
12. Governing law
These Terms are governed by the laws of the State of South Carolina, USA, without regard to conflict-of-law rules. Any dispute will be heard in the state or federal courts located in South Carolina, unless the law of your country requires otherwise. Mandatory consumer protection laws of the country where you live still apply.
